The ruling at the Paris Court of Appeal will be held on October 9

On February 13, 2023, the Tahei Auti Ia Moorea Federation was granted by the civil court of first instance the appointment of an expert tasked with establishing a list of violations committed by SNC Paetou in connection with the development work on the Paetou site.

Anxious to prevent the disclosure to the general public of information that could be prejudicial to it, SNC Paetou appealed this order on May 9, 2023.

On June 10, 2024, the Papeete Court of Appeal upheld SNC Paetou’s request, thereby depriving the Federation of the benefit of an expert opinion that would have exposed SNC Paetou’s criminal practices.

It should be noted that this ruling does not call into question the need for an expert opinion, but only challenges the admissibility of the Federation’s action on the grounds that the minutes of its Executive Committee meeting were not sufficiently precise to justify an action before the judge hearing the application for interim relief.

Once again, the Federation is prohibited from taking substantive action against the proven offenses committed by SNC Paetou on the basis of a simple technicality.

The Federation, in consultation with its lawyer, reserves the right to take a new decision that is admissible in form.

In the meantime, the Federation reiterates that it has filed an appeal with the Paris Administrative Court of Appeal against the regularization of the works and the building permit granted to Mr. and Mrs. Mantovani for the construction of a commercial complex (Gemo, Tahiti Pas Cher, and Home Décoration) on plot CI 13 of the Paetou site.

The fight continues to ensure that Moorea’s ecological and historical heritage is not sacrificed for the benefit of private interests.
