Terre Paetou, the interim relief judge orders an expert appraisal
The Tahei’auti ia Moorea federation has obtained a court order for an expert appraisal of the earthworks carried out by SNC Paetou in Moorea, which are said to have exceeded authorized volumes.
The Tahei’auti ia Moorea federation has won its case: its summary proceedings brought several months ago against SNC Paetou were finally heard on Monday, and the summary proceedings judge granted its request for the appointment of an expert to determine whether the company had complied with the earthworks authorizations granted for the construction of a dozen industrial lots on the mountain side of Teavaro.
As is often the case, the opposing party argued that the federation lacked standing and interest in the case. The judge, on the other hand, considered that the federation’s articles of association clearly allowed it to act even in the case of a project on private land, and that its president had been duly empowered to take legal action. He also pointed out that Tahai’auti ia Moorea had produced a report dated April 2022 attesting to work carried out beyond the authorizations obtained and the scope of the impact study carried out in 2020 – at a time when the developer was also planning 20 residential lots.
Under these conditions, it would be difficult to do otherwise than accede to Tahei’auti ia Moorea’s request to appoint an expert, whose report is due within the next three months.
On the other hand, another plaintiff was unable to establish his interest in the case: he claims to be a neighbor of the Paetou land and to be suffering from “abnormal neighborhood disturbances”, but was unable to prove his status as owner.
